Seek Answers-It's Your Right
By Noor Mohamed

The information sought from the Coffee Board under RTI Act helped me in filing of the writ petition.

In my article, “Our Right to Question” in the July 2006 issue of this publication, I had written about the use of RTI Act 2005 to get what legally belongs to you. I am happy to inform readers that the High Court has admitted my writ petition to write off loans of Coffee Planters. This piece of information as of now will be of great solace to coffee growers who have every other day been committing suicide due to mounting loans. The information sought from the Coffee Board under RTI Act helped me in filing of the writ petition.

Now Windsor Manor Hotel, which is a Wakf property has been enjoying with impunity so far. Now information I got under RTI has given me ‘teeth’ to cancel the agreement of the lease should I succeed. I will, succeed where Karnataka Wakf Board, the past, and present have failed. The full text of my letter under RTI is given for the benefit of readers as it may serve as a guide to those who want to use RTI.

In answer to my letter, the P.I.O. did not provide me an answer to my question if alcohol is being sold in Wakf property and what action they would take to carry out eviction. Later on appeal, the CEO has written to me that he will carry out eviction if brought to his notice.

Finally I had written a letter to the Prime Minister, Dr. Manmohan Singh to carryout its pledge to evict encroachments from Wakf Properties for which he promptly responded in 7 days. But bureaucrats of Karnataka have frustrated me for 7 months to give me a copy of the Prime Minister’s letter, but I will get the copy of the Prime Minister’s letter under RTI.

Letter to P.I.O

Information sought from P.I.O, Wakf Board, Bangalore as per RTI Act (Postal Order for Rs.10/- enclosed as fee)

Please Answer:

1. Is Windsor Manor a Wakf property registered with you or not.

Yes or No? If yes,

The Government, by Excise Secretary, Deputy Commissioner Excise has sent me photocopies of liquor being sold at Windsor Manor both wholesale and retail. “Copies enclosed”.

They also have said that the original license issued to Windsor Manor cannot be found with the government.

The selling of liquor is violation of Excise Act and is obnoxious to our community and also violates Wakf Act.

I do not know under what circumstances alcohol was allowed to be sold. But please answer me.

2. Has Wakf Board ever objected to selling of alcohol at Windsor Manor, if so a copy may be given. Recently the Central Government cancelled premises given to a prominent MP in Delhi for using it for illegal purpose. I want you to take same steps to cancel the agreement with Windsor, do not take shelter under subjudice, this is an illegal act, which is come to your knowledge and now will you take steps to cancel the agreement or not ? This is my third question ?

3. If so, by what date ?

4. If you do not take steps for cancellation, it will prove beyond doubt your connivance.
